Terms of Service
These terms govern your use of the IT & Automation website and the C-ERP software. By accessing the site or purchasing a license you agree to these terms.
Acceptance of terms
By accessing itsoftwareautomation.ro, downloading C-ERP, or purchasing a license, you confirm that you have read, understood, and agreed to these Terms of Service and our Privacy & Data Protection notice. If you do not agree, do not use the site or software.
These terms apply to all visitors, users, and customers, whether acting on behalf of themselves or a legal entity.
Services offered
IT & Automation provides the following through this website:
- C-ERP software — a Windows desktop application for B2B compensation order management, available as a free trial and as a paid, hardware-locked license.
- Documentation and resources — manuals, templates, and technical guides available for download.
- Engineering services — industrial automation, IT infrastructure, and drone solutions offered on a project basis. Terms for individual projects are governed by a separate service agreement.
- Contact & support — enquiries submitted via the contact form are handled on a best-effort basis.
C-ERP software license
Free trial. C-ERP may be used free of charge for up to 5 full compensation orders. No registration or credit card is required for the trial.
Paid license. A commercial license (299 RON, one-time payment) unlocks unlimited use and is bound to a single machine via a hardware fingerprint (Machine ID). The license is non-transferable and cannot be moved to a different computer without purchasing a new license or contacting support.
Permitted use. The license grants you a personal, non-exclusive, non-sublicensable right to install and use C-ERP on the licensed machine for lawful business purposes.
- You may not reverse-engineer, decompile, or modify the software.
- You may not redistribute, resell, or sublicense the software or license file.
- You may not use the software to process data in violation of applicable law.
Updates. The license includes maintenance updates, bug fixes, and minor improvements to the C-ERP application. Major versions, new modules, or separately developed functionality may be made available under a separate commercial offer.
Delivery. The .lic license file is delivered by email within 24 working hours of payment confirmation. Delivery requires a valid Machine ID and email address.
Payments & refunds
Price. The C-ERP license costs 299 RON, one-time payment, with applicable taxes included, according to the provider's fiscal regime. No subscription or renewal fees apply.
Payment processing. Payments are processed by a third-party payment service provider. IT & Automation Solutions does not store card details. A fiscal document is issued for every confirmed order, in accordance with applicable Romanian law.
Delivery. The C-ERP license is a digital product delivered electronically. The .lic license file is generated for the Machine ID provided by the buyer and is sent to the email address indicated in the order, within no more than 24 working hours from payment confirmation and validation of the required data.
Right of withdrawal. Where the buyer qualifies as a consumer, they benefit, in principle, from the legal right of withdrawal from distance contracts, within the period provided by O.U.G. no. 34/2014, art. 9, subject to the exceptions provided by law.
By placing the order, the buyer may expressly request that the C-ERP digital license be issued and delivered before the expiry of the legal withdrawal period. In that case, the buyer confirms that they are aware that, once the .lic file associated with the provided Machine ID has been issued and transmitted, they lose the right of withdrawal, in accordance with O.U.G. no. 34/2014, art. 16 letter m), as amended by O.U.G. no. 58/2022.
Refunds. Before the .lic file is issued and transmitted, the buyer may request cancellation of the order and a refund of the amount paid, provided the license has not yet been generated and sent.
After the .lic file has been issued and transmitted, as a result of the buyer's express consent to digital delivery before the expiry of the withdrawal period, refunds are no longer available for a simple change of mind or renunciation of the product, in accordance with O.U.G. no. 34/2014, art. 16 letter m).
Non-delivery or non-conformity. This policy does not limit the consumer's legal rights in case of non-delivery, wrong delivery, or lack of conformity of the digital content, under O.U.G. no. 141/2021 on contracts for the supply of digital content and digital services, including art. 12 and art. 13. In such situations, the buyer should contact us at info@itsoftwareautomation.com, and the issue will be analysed and remedied in accordance with applicable law.
Defective delivery. If the .lic file cannot be used due to an error attributable to us or was issued incorrectly, we will remedy the problem by resending, correcting, or reissuing the license, as appropriate.
Acceptable use
You agree not to use the website or software to:
- Violate any applicable law or regulation.
- Transmit malicious code, spam, or unauthorized automated requests.
- Attempt to gain unauthorized access to our systems or data.
- Misrepresent your identity or Machine ID to obtain a license fraudulently.
- Interfere with the availability or performance of the website or its services.
We reserve the right to suspend or terminate access for violations without notice.
Intellectual property
All content on this website — including text, graphics, logos, software, and documentation — is the intellectual property of IT & Automation Solutions and is protected under Romanian and EU copyright law.
Purchasing a license grants you a right to use C-ERP as described above; it does not transfer any ownership of the software or its underlying code.
You may download and use documentation files for personal or internal business use. Redistribution of documentation without permission is not permitted.
Limitation of liability
The website and software are provided "as is", without warranty of any kind, express or implied. We do not warrant that the software will be error-free or uninterrupted.
To the maximum extent permitted by Romanian law, IT & Automation shall not be liable for any indirect, incidental, or consequential damages arising from your use of the website or software, including loss of data or business interruption.
Our total liability for any claim arising from the purchase of a C-ERP license shall not exceed the amount you paid for that license (299 RON).
Governing law & disputes
These terms are governed by the laws of Romania. Any disputes arising from these terms or the use of our services shall be subject to the jurisdiction of the competent courts in Romania.
Before initiating legal proceedings, you agree to contact us in good faith to resolve the dispute informally.
Changes to these terms
We may update these terms from time to time. The "Effective" date at the top of the page reflects the most recent revision. Continued use of the website or software after changes are posted constitutes your acceptance of the updated terms.
Material changes will be communicated through a notice on the website.
